3. cookies
The Internet pages of the Cuda GmbH use cookies. Cookies are text files that are placed and stored on a computer system via an Internet browser.
Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string that allows websites and servers to be assigned to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognised and identified via the unique cookie ID.
Through the use of cookies, the Cuda GmbH can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.
Cookies can be used to optimise the information and offers on our website for the benefit of the user. As already mentioned, cookies enable us to recognise the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website because this is taken over by the website and the cookie stored on the user’s computer system. Another example is the cookie for a shopping basket in an online shop. The online shop remembers the items that a customer has placed in the virtual shopping basket via a cookie.
The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an internet browser or other software programmes. This is possible in all common internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.
4. collection of general data and information
The website of the Cuda GmbH collects a series of general data and information when a data subject or automated system calls up the website. This general data and information is stored in the server log files. The (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-websites which are accessed via an accessing system on our website can be recorded, (5) the date and time of access to the website, (6) an internet protocol address (IP address), (7) the internet service provider of the accessing system and (8) other similar data and information used for security purposes in the event of attacks on our information technology systems.
When using these general data and information, the Cuda GmbH does not draw any conclusions about the data subject. Rather, this information is required to (1) correctly deliver the contents of our website, (2) optimise the contents of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. Therefore, the Cuda GmbH analyses anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.
5. contact possibility via the website
The website of the Cuda GmbH contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the data controller by e-mail or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data is not passed on to third parties.

If one of the above conditions is met, and a data subject wishes to request the restriction of personal data stored by Cuda GmbH, they may, at any time, contact an employee of the controller. The employee of Cuda GmbH will arrange the restriction of the processing.
Right to Data Portability Every data subject shall have the right granted by the European legislator to receive the personal data concerning them, which was provided by the data subject to a controller, in a structured, commonly used, and machine-readable format. They shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, or on a contract pursuant to Article 6(1)(b) GDPR, and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, in exercising their right to data portability pursuant to Article 20(1) GDPR, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

In addition, the data subject has the right, on grounds relating to their particular situation, to object to processing of personal data concerning them, which is carried out by Cuda GmbH for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
To exercise the right to object, the data subject may directly contact any employee of Cuda GmbH or another employee. Furthermore, the data subject is free in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to use their right to object by automated means using technical specifications.
Automated Individual Decision-Making, Including Profiling Every data subject shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, as long as the decision (1) is not necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) is not authorized by Union or Member State law to which the controller is subject, and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is not based on the data subject’s explicit consent.
If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) it is based on the data subject’s explicit consent, Cuda GmbH shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express their point of view, and to contest the decision.
If the data subject wishes to exercise the rights concerning automated individual decision-making, they may, at any time, contact an employee of the controller.

8. Data protection in applications and the application process
The controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing can also be carried out electronically. This is particularly the case when an applicant submits corresponding application documents electronically, for example via email or a web form on the website, to the controller. If the controller concludes an employment contract with an applicant, the submitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. If no employment contract is concluded with the applicant by the controller, the application documents will be automatically deleted two months after the rejection decision is announced, provided that no other legitimate interests of the controller oppose the deletion. Another legitimate interest in this sense is, for example, an obligation to provide evidence in a procedure under the General Equal Treatment Act (AGG).
9. Privacy policy on the use and application of Facebook
The controller has integrated components of the company Facebook on this website. Facebook is a social network.
A social network is an Internet-based social meeting place, an online community, that usually allows users to communicate with each other and interact in the virtual space. A social network can serve as a platform for exchanging opinions and experiences or allows the Internet community to provide personal or company-related information. Facebook allows users of the social network to create private profiles, upload photos, and network through friend requests, among other things.
The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. The controller for processing personal data is, if a data subject lives outside the USA or Canada, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
With each visit to one of the individual pages of this website, which is operated by the controller and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be accessed at https://developers.facebook.com/docs/plugins/?locale=en_US. As part of this technical procedure, Facebook becomes aware of which specific subpage of our website is visited by the data subject.
If the data subject is logged in at the same time on Facebook, Facebook recognizes with each visit to our website by the data subject—and for the entire duration of their stay on our website—which specific subpage of our website the data subject visits. This information is collected by the Facebook component and assigned to the respective Facebook account of the data subject by Facebook. If the data subject clicks on one of the Facebook buttons integrated on our website, for example, the “Like” button, or the data subject submits a comment, Facebook assigns this information to the personal Facebook user account of the data subject and stores this personal data.
Facebook always receives information via the Facebook component that the data subject has visited our website if the data subject is logged in to Facebook at the time of the call-up to our website; this occurs regardless of whether the data subject clicks on the Facebook component or not. If such transmission of information to Facebook is not desired by the data subject, they can prevent this by logging out of their Facebook account before a call-up to our website is made.
The data protection guideline published by Facebook, which is available at https://www.facebook.com/about/privacy/, provides information about the collection, processing, and use of personal data by Facebook. It also explains the settings options Facebook offers to protect the privacy of the data subject. Additionally, various applications are available that allow for the suppression of data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.
10. Privacy policy on the use and application of Google AdSense
The controller has integrated Google AdSense on this website. Google AdSense is an online service that allows the placement of advertising on third-party sites. Google AdSense is based on an algorithm that selects the advertisements displayed on third-party sites to match the content of the respective third-party site. Google AdSense enables interest-based targeting of the Internet user, which is implemented by generating individual user profiles.
The operating company of the Google AdSense component is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.
The purpose of the Google AdSense component is to integrate advertisements on our website. Google AdSense sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Alphabet Inc. is enabled to analyze the use of our website. With each visit to one of the individual pages of this website, which is operated by the controller and on which a Google AdSense component has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Google AdSense component to transmit data to Alphabet Inc. for the purpose of online advertising and the settlement of commissions. As part of this technical procedure, Alphabet Inc. obtains knowledge of personal data, such as the IP address of the data subject, which serves Alphabet Inc., among other things, to track the origin of visitors and clicks and subsequently enable commission settlements.
The data subject can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding adjustment of the Internet browser used, thereby permanently opposing the setting of cookies. Such an adjustment of the used Internet browser would also prevent Alphabet Inc. from setting a cookie on the information technology system of the data subject. In addition, a cookie already set by Alphabet Inc. can be deleted at any time via the Internet browser or other software programs.
Google AdSense also uses so-called tracking pixels. A tracking pixel is a miniature graphic embedded in web pages to enable a log file recording and log file analysis, through which statistical analysis can be conducted. Based on the embedded tracking pixel, Alphabet Inc. can determine whether and when a website was opened by a data subject, and which links were clicked on by the data subject. Tracking pixels serve, among other things, to evaluate the visitor flow of a website.
Through Google AdSense, personal data and information, which also includes the IP address, are transferred to Alphabet Inc. in the United States of America, where they are stored and processed. Alphabet Inc. may disclose the personal data collected through this technical procedure to third parties.
Google AdSense is explained in more detail at https://www.google.com/intl/en/adsense/start/.
11. Privacy policy on the use and application of Google Remarketing
The controller has integrated Google Remarketing services on this website. Google Remarketing is a function of Google AdWords that allows a company to display advertising to Internet users who have previously visited the company’s website. The integration of Google Remarketing allows a company to create user-related advertising and subsequently display interest-relevant advertisements to the Internet user.
The operating company of the Google Remarketing services is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.
The purpose of Google Remarketing is the insertion of interest-relevant advertising. Google Remarketing allows us to display ads through the Google advertising network or to display them on other websites tailored to the individual needs and interests of Internet users.
Google Remarketing sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is enabled to recognize the visitor to our website if they subsequently visit websites that are also members of the Google advertising network. With each visit to a website on which the Google Remarketing service has been integrated, the Internet browser of the data subject automatically identifies itself to Google. As part of this technical procedure, Google obtains knowledge of personal data, such as the IP address or browsing behavior of the user, which Google uses, among other things, to display interest-based advertising.
Through the cookie, personal information, such as the websites visited by the data subject, is stored. Every time our website is visited, personal data, including the IP address of the Internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass this personal data collected through the technical procedure on to third parties.
The data subject can prevent the setting of cookies by our website, as already mentioned above, at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the data subject. In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.
Furthermore, the data subject has the possibility of objecting to interest-based advertising by Google. For this purpose, the data subject must call up the link www.google.de/settings/ads from each of the Internet browsers they use and make the desired settings there.
Further information and the applicable data protection regulations of Google can be accessed at https://www.google.de/intl/en/policies/privacy/.
12. Privacy policy on the use and application of Google AdWords
The controller has integrated Google AdWords on this website. Google AdWords is an Internet advertising service that allows advertisers to place ads both in Google’s search engine results and in the Google advertising network. Google AdWords allows an advertiser to predefine specific keywords that will display an ad in Google’s search engine results when the user retrieves a keyword-relevant search result using the search engine. In the Google advertising network, the ads are distributed on relevant websites by means of an automatic algorithm, taking into account the previously defined keywords.
The operating company of the Google AdWords services is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.
The purpose of Google AdWords is to promote our website by displaying interest-relevant advertising on the websites of third-party companies and in Google’s search engine results and by displaying third-party advertisements on our website.
If a data subject reaches our website via a Google ad, a conversion cookie will be placed on the information technology system of the data subject by Google. What cookies are has already been explained above. A conversion cookie loses its validity after thirty days and is not used to identify the data subject. If the conversion cookie has not expired, it is used to track whether certain subpages, such as the shopping cart of an online shop system, were called up on our website. Through the conversion cookie, both we and Google can track whether a data subject who came to our website via an AdWords ad generated a sale, i.e., completed or canceled a purchase.
The data and information collected through the use of the conversion cookie are used by Google to create visit statistics for our website. These visit statistics are used by us to determine the total number of users who were referred to us via AdWords ads, i.e., to determine the success or failure of each AdWords ad and to optimize our AdWords ads for the future. Neither our company nor other Google AdWords advertisers receive information from Google that could identify the data subject.
Through the conversion cookie, personal information, such as the websites visited by the data subject, is stored. Every time our website is visited, personal data, including the IP address of the Internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass this personal data collected through the technical procedure on to third parties.
The data subject can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a conversion cookie on the information technology system of the data subject. In addition, a cookie already set by Google AdWords can be deleted at any time via the Internet browser or other software programs.
13. Privacy policy on the use and application of Instagram
The controller has integrated components of the Instagram service on this website. Instagram is a service that can be qualified as an audiovisual platform, which allows users to share photos and videos and also enables such data to be disseminated on other social networks.
The operating company of the Instagram services is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
With each visit to one of the individual pages of this website, which is operated by the controller and on which an Instagram component (Insta button) has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Instagram component to download a representation of the corresponding Instagram component from Instagram. As part of this technical procedure, Instagram becomes aware of which specific subpage of our website was visited by the data subject.
If the data subject is logged in to Instagram at the same time, Instagram recognizes with each visit to our website by the data subject—and for the entire duration of their stay on our website—which specific subpage of our website the data subject visits. This information is collected by the Instagram component and assigned by Instagram to the respective Instagram account of the data subject. If the data subject clicks on one of the Instagram buttons integrated on our website, the data and information transferred with this are assigned to the personal Instagram user account of the data subject and are stored and processed by Instagram.
Instagram always receives information via the Instagram component that the data subject has visited our website if the data subject is logged in to Instagram at the time of the call-up to our website; this occurs regardless of whether the data subject clicks on the Instagram component or not. If such a transmission of information to Instagram is not desired by the data subject, they can prevent this by logging out of their Instagram account before a call-up to our website is made.

14. Legal basis for processing
Article 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Article 6(1)(b) GDPR. The same applies to such processing operations that are necessary for carrying out pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Article 6(1)(c) GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance data, or other vital information would need to be passed on to a doctor, hospital, or other third party. Then the processing would be based on Article 6(1)(d) GDPR. Finally, processing operations could be based on Article 6(1)(f) GDPR. On this legal basis, processing operations that are not covered by any of the above-mentioned legal grounds are permitted if the processing is necessary for the purposes of the legitimate interests pursued by our company or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject that require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. It considered that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 Sentence 2 GDPR).
15. Legitimate interests pursued by the controller or by a third party
Where the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is to carry out our business in favor of the well-being of all our employees and shareholders.
16. Period for which the personal data will be stored
The criterion used to determine the period of storage of personal data is the respective statutory retention period. After the expiry of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

3. Cookies
The websites of Cuda GmbH use cookies. Cookies are text files that are stored and saved on a computer system via an Internet browser.
Many websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited websites and servers to distinguish the individual browser of the affected person from other Internet browsers that contain different cookies. A specific Internet browser can be recognized and identified using the unique cookie ID.
By using cookies, Cuda GmbH can provide users of this website with more user-friendly services that would not be possible without the cookie setting.
Using a cookie, the information and offers on our website can be optimized with the user in mind. As mentioned earlier, cookies enable us to recognize users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website because this is taken care of by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping cart in an online store. The online store remembers the items that a customer has placed in the virtual shopping cart via a cookie.
The affected person can prevent the setting of cookies by our website at any time by adjusting the settings of the Internet browser used, thus permanently objecting to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the affected person deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.

This anonymously collected data and information are therefore statistically analyzed by Cuda GmbH with the aim of increasing data protection and data security in our company, ultimately ensuring an optimal level of protection for the personal data we process.
